1. Acceptance of Terms

Welcome to Hire4Europe. By accessing or using our website, mobile application, or any services provided by Hire4Europe ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and Hire4Europe. Your continued use of the Platform signifies your acceptance of any modifications to these Terms.

Important Notice

Please read these Terms carefully before using our services. By creating an account or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions

For the purposes of these Terms:

  • "Platform" refers to the Hire4Europe website, mobile applications, and all related services.
  • "User" means any person who accesses or uses the Platform, including Job Seekers and Employers.
  • "Job Seeker" means an individual seeking employment opportunities through the Platform.
  • "Employer" means a company, organization, or individual posting job opportunities and seeking candidates.
  • "Content" means any information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials.
  • "Job Posting" means a job advertisement published by an Employer on the Platform.
  • "Application" means a Job Seeker's submission of their profile/resume in response to a Job Posting.
  • "We," "Us," "Our" refers to Hire4Europe.

3. Eligibility

3.1 Age Requirement

You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement. If we discover that a person under 16 has created an account, we will terminate that account immediately.

3.2 Legal Capacity

You must have the legal capacity to enter into binding contracts. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3.3 Geographic Restrictions

While our Platform primarily serves the European job market, we welcome users from around the world, subject to compliance with applicable local laws and regulations.

4. User Accounts

4.1 Account Creation

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4.2 Account Types

We offer two types of accounts:

  • Job Seeker Accounts: For individuals seeking employment opportunities
  • Employer Accounts: For companies and organizations posting job opportunities

You may only create one account per email address. Creating multiple accounts may result in suspension or termination of all accounts.

4.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. Hire4Europe will not be liable for any loss or damage arising from your failure to protect your account information.

5. Description of Services

5.1 Platform Services

Hire4Europe provides an online platform that connects Job Seekers with Employers. Our services include:

  • Job posting and search functionality
  • Profile creation and management for Job Seekers
  • Application submission and tracking
  • Messaging between Job Seekers and Employers
  • Job alerts and notifications
  • Resume/CV management
  • Candidate search and filtering for Employers
  • Analytics and reporting tools

5.2 Service Availability

We strive to provide uninterrupted service but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice.

6. Terms for Job Seekers

6.1 Profile Information

As a Job Seeker, you agree to:

  • Provide truthful and accurate information in your profile, CV, and applications
  • Not misrepresent your qualifications, experience, or skills
  • Keep your profile information current and up to date
  • Only upload content that you have the right to share
  • Not include false, misleading, or fraudulent information

6.2 Applications

When applying for jobs through the Platform:

  • You authorize us to share your profile and application with the relevant Employer
  • You understand that we are not a party to any employment agreement between you and an Employer
  • You are responsible for your own employment decisions and due diligence
  • You should verify the legitimacy of job postings and Employers independently

6.3 Job Alerts

If you opt-in to receive job alerts, you consent to receiving email notifications about relevant job opportunities. You may unsubscribe from job alerts at any time through your account settings.

7. Terms for Employers

7.1 Job Postings

As an Employer, you agree that all Job Postings must:

  • Represent genuine, legitimate job opportunities
  • Accurately describe the position, requirements, and company
  • Comply with all applicable employment laws and regulations
  • Not contain discriminatory language or requirements
  • Not misrepresent the nature of employment (e.g., presenting commission-based work as salaried)
  • Not be used for purposes other than recruitment (e.g., marketing, lead generation)

7.2 Prohibited Job Postings

You may NOT post jobs that:

  • Require upfront payments or fees from candidates
  • Are primarily commission-based without disclosure
  • Involve multi-level marketing, pyramid schemes, or similar structures
  • Offer "business opportunities" rather than employment
  • Violate intellectual property rights
  • Promote illegal activities or services
  • Are sexually explicit or offensive
  • Discriminate based on protected characteristics

7.3 Candidate Information

When you receive applications or access candidate profiles:

  • You must use candidate data solely for recruitment purposes
  • You must comply with GDPR and applicable data protection laws
  • You must not share candidate information with third parties without consent
  • You must delete candidate data according to legal retention requirements
  • You must respect candidate privacy and confidentiality

7.4 Company Information

You warrant that all company information provided is accurate and that you have the authority to represent the company on the Platform.

8. Prohibited Activities

Users are strictly prohibited from:

  1. Fraudulent Activity: Creating fake accounts, posting false information, or engaging in any deceptive practices
  2. Scraping: Using automated tools to scrape, harvest, or collect data from the Platform
  3. Harassment: Harassing, threatening, or intimidating other users
  4. Spam: Sending unsolicited messages or advertisements
  5. Malicious Code: Uploading viruses, malware, or other harmful code
  6. Reverse Engineering: Attempting to reverse engineer, decompile, or hack the Platform
  7. Unauthorized Access: Accessing accounts or data that do not belong to you
  8. Violation of Laws: Using the Platform for any illegal purpose
  9. Discrimination: Discriminating based on race, religion, gender, age, disability, or other protected characteristics
  10. Impersonation: Impersonating another person or entity
  11. Circumvention: Attempting to circumvent any security measures or restrictions
  12. Interference: Interfering with the proper functioning of the Platform

Violation Consequences

Violation of these prohibited activities may result in immediate account termination, legal action, and reporting to appropriate authorities.

9. User Content and Conduct

9.1 Your Content

You retain ownership of any content you submit to the Platform (profiles, resumes, job postings, messages, etc.). However, by submitting content, you grant Hire4Europe a worldwide, non-exclusive, royalty-free license to:

  • Use, reproduce, and display your content on the Platform
  • Distribute your content to facilitate job matching and applications
  • Create derivative works for operational purposes
  • Archive and store your content for the duration specified in our Privacy Policy

9.2 Content Standards

All user content must:

  • Be truthful and accurate
  • Not infringe on third-party rights
  • Not contain offensive, defamatory, or illegal material
  • Not violate privacy or confidentiality obligations
  • Comply with applicable laws and regulations

9.3 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

10. Intellectual Property Rights

10.1 Platform Ownership

The Platform, including all software, design, text, graphics, logos, and other content (excluding user-generated content), is owned by Hire4Europe and protected by copyright, trademark, and other intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purposes. This license does not include the right to:

  • Modify, copy, or create derivative works
  • Distribute, sell, or transfer any part of the Platform
  • Use our trademarks or branding without permission
  • Remove copyright or proprietary notices

10.3 Trademarks

"Hire4Europe" and our logo are trademarks of Hire4Europe. You may not use these marks without our prior written consent.

11. Payments and Fees

11.1 Free Services for Job Seekers

All basic job seeker accounts are completely free and include:

  • Profile creation and management
  • Unlimited job applications
  • Resume/CV upload and storage
  • Job search and filtering
  • Email job alerts
  • Application tracking
  • Messaging with employers

Job seekers are never required to pay any fees to use the Hire4Europe platform.

11.2 Services for Employers - What You Purchase

Employers can purchase the following digital services and products:

11.2.1 Job Posting Credits

Product Description: Digital credits allowing employers to publish job listings on the Hire4Europe platform for a specified duration (typically 30, 60, or 90 days).

What's Included:

  • Job posting visible to all registered job seekers
  • Searchable and filterable job listing in the jobs database
  • Application management dashboard
  • Candidate profile viewing
  • Direct messaging with applicants
  • Basic analytics (views, applications received)
  • Email notifications for new applications

11.2.2 Featured Job Listings

Product Description: Premium placement service that promotes your job posting with enhanced visibility.

What's Included:

  • Priority placement in search results
  • Highlighted job card with distinctive styling
  • Featured badge on job listing
  • Homepage featured jobs section placement (rotation)
  • Increased visibility to job seekers (up to 5x more views)
  • Extended job posting duration

11.2.3 Candidate Database Access

Product Description: Subscription service granting access to actively search our database of job seeker profiles.

What's Included:

  • Advanced search and filtering tools (by skills, experience, location, education)
  • Access to candidate profiles and resumes
  • Ability to contact candidates directly
  • Saved searches and candidate lists
  • Profile bookmarking and notes
  • Monthly subscription (renewable)

11.3 Payment Terms and Processing

Payment Processing: All payments are securely processed through Netopia Payments, a certified payment service provider compliant with PCI DSS standards and Romanian/EU regulations.

11.3.1 Accepted Payment Methods

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Bank transfers (for enterprise clients)
  • Digital wallets (where available)

11.3.2 Payment Requirements

  • Payment is required upfront before service activation
  • All fees are listed in Romanian Lei (RON) and Euros (EUR)
  • Prices include applicable VAT (Value Added Tax) as required by Romanian law
  • You authorize us to charge your selected payment method for all fees incurred
  • Payment confirmation will be sent via email immediately upon successful transaction

11.3.3 Invoicing

  • Electronic invoices are issued for all transactions
  • Invoices are sent to your registered email address within 24 hours of payment
  • Invoices comply with Romanian fiscal regulations (ANAF)
  • For companies: Please provide complete billing information (CUI/CIF, company name, address)

11.4 Subscription Renewals

For subscription services:

  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You will receive an email reminder 7 days before renewal
  • Renewal charges occur on the same day each billing period
  • You can cancel auto-renewal at any time from your account settings
  • Cancellation takes effect at the end of the current billing period

11.5 Price Changes

We reserve the right to modify our pricing at any time. For existing subscriptions:

  • We will provide at least 30 days' notice of price changes
  • Price changes do not affect your current billing period
  • You may cancel your subscription before the new price takes effect
  • Continued use after the notice period constitutes acceptance of new pricing

11.6 Taxes

You are responsible for paying all applicable taxes, duties, and government charges associated with your purchase. All prices displayed include Romanian VAT where applicable. For EU business customers with a valid VAT number, reverse charge mechanism may apply according to EU VAT directives.

Secure Payment Processing

Your payment information is processed securely through Netopia Payments. Hire4Europe does not store your complete credit card information. All transactions are encrypted and comply with PCI DSS Level 1 security standards.

12. Delivery of Services

12.1 Service Delivery Timeline

Hire4Europe provides digital services that are delivered electronically through our online platform. The delivery timeline depends on payment processing status:

12.1.1 Instant Delivery (Immediate Access)

When payment is approved instantly by Netopia Payments:

  • Services are activated immediately upon successful payment confirmation
  • You receive instant access to purchased credits, features, or subscriptions
  • Confirmation email is sent within minutes
  • Job postings can be published immediately
  • Candidate database access is granted instantly

Applies to: Credit card and debit card payments processed successfully in real-time.

12.1.2 Delayed Delivery (Up to 24 Hours)

When payment is in processing status:

  • Services are activated within 24 hours of payment initiation
  • Payment verification by Netopia Payments may take up to 24 hours
  • You will receive email notification once payment is confirmed
  • Access is granted automatically upon payment confirmation
  • No manual intervention required

Applies to: Bank transfers, certain card payments requiring additional verification, or payments flagged for security review.

12.2 Delivery Method

All services and products are delivered digitally through the following methods:

12.2.1 For Job Posting Credits

  • Delivery: Credits are added to your employer account dashboard
  • Access: Log in to your account โ†’ Dashboard โ†’ "Post a Job"
  • Availability: Credits appear in your account balance immediately (instant) or within 24 hours (delayed)
  • Usage: Use credits to publish job listings at any time during their validity period

12.2.2 For Featured Listings

  • Delivery: Featured status is applied to your selected job posting
  • Activation: Featured badge and enhanced visibility activated automatically
  • Confirmation: Email confirmation with feature activation details
  • Duration: Featured period begins immediately upon activation

12.2.3 For Subscription Plans

  • Delivery: Account is upgraded to subscribed tier
  • Access: All subscription features are unlocked in your dashboard
  • Notification: Welcome email with subscription details and usage guide
  • Validity: Subscription period starts from the moment of activation

12.2.4 For Candidate Database Access

  • Delivery: Access granted through "Find Candidates" section
  • Tools: Search filters and candidate contact features unlocked
  • Guide: Tutorial email sent with best practices
  • Support: Priority customer support available for questions

12.3 Delivery Confirmation

You will receive confirmation of service delivery via:

  • Email notification to your registered email address
  • Dashboard notification visible upon login
  • Account activity log showing transaction and activation details
  • Invoice/Receipt containing purchase details

12.4 Delivery Issues

If you do not receive your purchased services within the specified timeframe:

  • Check your email (including spam/junk folders) for confirmation
  • Verify payment status in your account's "Billing History"
  • Contact support@hire4europe.com with your transaction reference number
  • We will investigate and resolve delivery issues within 4 business hours

Instant Payment Approval: Immediate access (0-5 minutes)
Payment Under Review: Access within 24 hours maximum
Business Hours: Monday-Friday, 9:00 AM - 6:00 PM EET
Support Response: Within 4 hours during business hours

13. Returns and Cancellations

13.1 Right of Withdrawal (EU Consumer Protection)

In accordance with EU Directive 2011/83/EU and Romanian Law 296/2004 regarding consumer protection, you have the right to withdraw from a purchase within 14 calendar days without providing a reason, with important exceptions detailed below.

13.2 Services Exempt from Withdrawal Right

IMPORTANT: According to Article 16 of EU Directive 2011/83/EU, the right of withdrawal does NOT apply to digital content or services where:

  • Performance has begun with your express prior consent
  • You acknowledge that you lose your right of withdrawal once performance begins

13.2.1 Non-Refundable Services (Performance Begun)

The following services cannot be refunded once activated or used:

  • Job posting credits - Once a job has been published using the credit
  • Featured listings - Once the job has been promoted and viewed
  • Candidate database access - Once you have accessed or viewed candidate profiles
  • Subscription plans - For the portion of time already used (pro-rated refunds may apply for unused time)

13.2.2 Refundable Services (No Performance)

You may request a full refund if:

  • Payment was processed but services were not yet activated
  • You have not used any credits, accessed any features, or published any jobs
  • Technical error prevented service delivery
  • You were charged incorrectly or duplicate charges occurred
  • Within 14 days of purchase and before service usage begins

13.3 Cancellation Process and Timeline

13.3.1 How to Cancel/Request Refund

To exercise your right of withdrawal or request a refund:

  1. Submit request via email: Send to billing@hire4europe.com
  2. Include required information:
    • Your full name and account email
    • Order/Transaction reference number
    • Date of purchase
    • Service(s) purchased
    • Reason for cancellation (optional for 14-day withdrawal)
  3. Await confirmation: We will confirm receipt within 24 hours

13.3.2 Cancellation Timeline

Step 1 - Request Acknowledgment: Within 24 hours of your request

  • We confirm receipt of your cancellation request
  • We verify your purchase details and eligibility for refund

Step 2 - Evaluation: Within 48 hours

  • We assess whether services were used or activated
  • We determine refund eligibility based on usage status
  • We notify you of approval or denial with explanation

Step 3 - Refund Processing: Within 14 calendar days of approval

  • Approved refunds are processed within 14 days (as required by EU law)
  • Refund is issued to the original payment method
  • You receive email confirmation with refund reference number

Step 4 - Bank Processing: Additional 3-10 business days

  • Your bank/card issuer may take 3-10 business days to credit your account
  • This timeline is controlled by your financial institution, not Hire4Europe

13.4 Subscription Cancellations

13.4.1 Cancel Auto-Renewal

You can cancel subscription auto-renewal at any time:

  • Method: Account Settings โ†’ Billing โ†’ "Cancel Subscription"
  • Effect: Cancellation takes effect at the end of current billing period
  • Access: You retain access to services until subscription expires
  • No refund: Cancelling auto-renewal does NOT refund the current period

13.4.2 Mid-Period Cancellation with Refund

For unused subscription time:

  • Eligibility: If you have not used subscription features extensively
  • Calculation: Pro-rated refund based on unused days
  • Example: Cancel 15 days into a 30-day subscription โ†’ 50% refund (minus processing fees)
  • Minimum usage threshold: No refund if >50% of subscription period has passed or >70% of credits used

13.5 Partial Refunds

In certain cases, partial refunds may be issued:

  • Unused credits: If you purchased a package but used only some credits
  • Service issues: If service was unavailable or degraded for a period
  • Billing errors: If you were overcharged
  • Calculation: Refund amount = (Total Paid / Total Credits) ร— Unused Credits

13.6 Non-Refundable Fees

The following are never refundable:

  • Payment processing fees (charged by Netopia Payments)
  • Services that were fully delivered and used
  • Promotional or discounted pricing differences (refund based on amount actually paid)
  • Services purchased more than 14 days ago and partially used

13.7 Refund Method

All approved refunds are processed as follows:

  • Refund destination: Original payment method only
  • Currency: Same currency as original purchase
  • Notification: Email confirmation with refund details and reference number
  • Tracking: Visible in your account's billing history

13.8 Exceptions and Special Circumstances

We may issue refunds outside normal policy in cases of:

  • Platform technical failures preventing service delivery
  • Unauthorized transactions (fraud/theft)
  • Significant service disruptions caused by Hire4Europe
  • Good faith errors or exceptional circumstances (evaluated case-by-case)

13.9 Dispute Resolution for Refunds

If your refund request is denied and you disagree:

  1. Contact our billing team at billing@hire4europe.com to discuss
  2. Request escalation to management for review
  3. If still unresolved, you may file a complaint with ANPC (Autoritatea Naศ›ionalฤƒ pentru Protecศ›ia Consumatorilor) in Romania
  4. EU consumers can use the European ODR platform: https://ec.europa.eu/consumers/odr

Important Notice Regarding Digital Services

By clicking "I agree" or "Purchase" during checkout, you expressly consent to the immediate delivery and performance of digital services, and you acknowledge that you will lose your right of withdrawal once the service has been fully performed or you have begun using the service.

This is in accordance with Article 16(m) of EU Directive 2011/83/EU.

14. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

We are committed to GDPR compliance and protecting your personal data. For detailed information about how we handle your data, please review our Privacy Policy.

15. Disclaimers

15.1 Platform "As Is"

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

15.2 No Employment Guarantee

We do not guarantee that:

  • Job Seekers will find employment through the Platform
  • Employers will find suitable candidates
  • Any job posting is legitimate or accurate
  • Users will achieve any particular results

15.3 Third-Party Content

We are not responsible for the accuracy, legality, or appropriateness of content provided by users or third parties. You use such content at your own risk.

15.4 No Verification

While we may implement verification measures, we do not guarantee the identity, qualifications, or legitimacy of any user, employer, or job posting. Users must conduct their own due diligence.

16. Limitation of Liability

16.1 Damages Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIREFOREUROPE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Platform
  • Damages resulting from unauthorized access to your account
  • Damages arising from interactions with other users

16.2 Maximum Liability

Our total liability to you for all claims arising from your use of the Platform shall not exceed the greater of: (a) โ‚ฌ100 EUR, or (b) the amount you paid us in the 12 months preceding the claim.

16.3 Exceptions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under applicable law

17. Indemnification

You agree to indemnify, defend, and hold harmless Hire4Europe, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your content or conduct on the Platform
  • Any employment relationship or dispute with another user

18. Termination

18.1 Termination by You

You may terminate your account at any time by:

  • Accessing your account settings and deleting your account
  • Contacting us at support@hire4europe.com

18.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms
  • We suspect fraudulent, illegal, or harmful activity
  • You fail to pay fees owed
  • We decide to discontinue the Platform
  • Required by law or court order

18.3 Effect of Termination

Upon termination:

  • Your right to access the Platform immediately ceases
  • Your content may be deleted according to our Privacy Policy
  • Outstanding payment obligations remain in effect
  • Provisions that should survive termination will continue (e.g., disclaimers, indemnification)

19. Dispute Resolution

19.1 Informal Resolution

Before filing a formal dispute, please contact us at legal@hire4europe.com to attempt to resolve the issue informally. We commit to working with you in good faith to reach a satisfactory resolution.

19.2 Mediation

If informal resolution fails, both parties agree to attempt mediation before pursuing litigation.

19.3 Arbitration

Any disputes that cannot be resolved through informal resolution or mediation shall be resolved through binding arbitration in accordance with the rules of the Romanian Arbitration Court, unless prohibited by applicable law.

19.4 Class Action Waiver

To the extent permitted by law, you agree that disputes will be resolved on an individual basis and not as part of a class action or collective proceeding.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania and the European Union, without regard to conflict of law principles. The courts of Galati, Romania shall have exclusive jurisdiction over any disputes, subject to the arbitration provisions above.

For users outside the EU, local mandatory consumer protection laws may also apply.

21. Modifications to Terms

21.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Send an email notification to registered users
  • Display a prominent notice on the Platform

21.2 Your Acceptance

Your continued use of the Platform after changes to the Terms constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Platform and may terminate your account.

21.3 Review Regularly

We encourage you to review these Terms periodically to stay informed of any updates.

Legal Notice

These Terms of Service constitute the entire agreement between you and Hire4Europe regarding your use of the Platform. If any provision is found to be unenforceable, the remaining provisions will continue in full effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
